Maryland Man Flees Scene of Motorcycle Crash that Leaves One Dead

By injuheis on March 31, 2009

Maryland State Police officials have arrested a Salisbury man wanted for questioning in a fatal hit-and-run motorcycle accident. This recent report in the Milford Beacon claims that the incident occurred around 3:20 in the afternoon on Monday, February 3, 2009. Delaware State Police officials say that the accident happened near the intersection of U.S. 13 and Whitesville Road in Delmar.

Police officials said that 25-year-old motorcyclist, Phillip Jester of Milford, hit the rear of a pickup truck driven by Justin Mitchell. Mr. Jester lost control of his motorcycle after hitting the truck, slid under a Honda Civic, and died of his injuries at the scene. The police claim that Mitchell continued without stopping after the accident occurred but was followed home by a witness. Mitchell was contacted by the Maryland State Police on his cell phone sometime later that day and was convinced to surrender to authorities for questioning. The motorcycle accident is still under investigation. Mitchell is being held at the Maryland State Police barracks pending his extradition to Delaware.

According to this recent WTOP 103.5 FM report, a college student attending McDaniel College was killed in early February in a hit-and-run accident. Police officials in Westminster, MD, say that 19-year-old Thomas Rouleau of Gilboa, NY, died at the scene from injuries he suffered in the auto accident. A spokesman for the Westminster Police Department said that Rouleau was in a car with four other McDaniel College students when their car was rear-ended by a Ford pickup truck late on the evening of February 6, 2009.

The driver of the Ford pickup fled the scene after the car accident in Maryland and police have not yet located the truck or driver involved in the deadly car accident. Westminster police officials say that the fatal rear-end crash occurred just moments after the pickup truck had been involved in a minor accident while backing out of a parking space. The four other McDaniel College students were treated for minor injuries and released from area hospitals.

Motorcycle Season Coming Soon: The Fear of Accidents Rise

The Baltimore Sun reports in an article that the authorities have identified the 42-year old man who died this past Sunday, March 8, when his 2008 Harley Davidson Sportster crashed into a 2009 Mercury Grand Marquis near St. Agnes hospital, as Curtis Amburgey. There is no word on whether or not Mr. Amburgey was wearing a helmet while riding, even though Maryland law requires a helmet to be worn at all times when riding on public roads.

According to the Sun and Maryland State Police, 92 people have already died on the Maryland roads this year alone, as compared to the 77 from last year. In the current economic climate, more people are turning to motorcycles as the favored mode of transportation to save on fuel expenses, which could account for the increase in fatalities.

Experienced Maryland motorcycle accident attorney Steven H. Heisler reminds motorcyclists to stay safe by driving defensively this motorcycle season and cautions other vehicle operators to be alert and mindful of the motorcyclists on the roadways.

According to the Sun, when Christine Schoppert was waiting to make a left turn into the Creative Garden Learning Center where her daughter attends nursery school, she was rammed in the back by 24-year old Brian Weatherley’s Chrysler Concord, which pushed her Nissan Maxima into the pathway of a commercial garbage truck. DC Auto Accidents Due to Late Winter Storm Slick Driving Conditions

By injuheis on March 10, 2009

The DC Examiner reports in an article that the recent late-winter snowstorm created dangerous driving conditions for the DC metro area. Ice, sleet, and snow can make driving extremely hazardous. During the spate of bad winter weather that descended on the DC metro the first week of March, dozens of car accidents occurred during the morning commute to work. Fortunately, most of these accidents were minor.

The story mentions a road hazard called “black ice.” This is a condition caused when melted snow freezes on asphalt and roadway surfaces, creating a very hard-to-see layer of ice. Black ice is often found on bridges and overpasses because the roadways at those locations are not insulated by the ground, causing them to freeze over more quickly than the remaining roadway.

With luck, the recent storm will be the last of the wintery conditions for this season. Here is a quick review of defensive driving conditions that can help you steer clear of an accident:

  • Slow down - slick conditions dramatically increase required braking distances
  • Stay visible -  lights and signals help distinguish your car from the snow and background
  • Give other drivers room to brake and turn

Experienced Maryland auto accident attorney Steven H. Heisler reminds you to stay alert and drive defensively in these last days of winter.

If you do get into an accident, Mr. Heisler will protect your rights, work hard on your behalf, and help you navigate the legal course to justice. Maryland Patients Can Sue Drug Makers: Supreme Court Ruling

By injuheis on March 5, 2009

The Baltimore Sun reports in a story that a Supreme Court ruling upholds the right for patients to sue drug manufacturers.

According to the Sun, the Bush administration made a push in its final days to shield drug manufacturers from personal injury claims. The pro-manufacturer strategy claimed that FDA approval of a given drug removed the ability of juries to decide whether that drug had dangerous effects.

In its 6-3 ruling, the Supreme Court disagreed with this argument and sent a clear message to consumers and drug manufacturers that product liability lawsuits and dangerous drug lawsuits are legitimate means of protecting the interests of consumers.

The case that brought this matter to the attention of the Supreme Court involved a Vermont musician, Diane Levine, who developed gangrene in one of her arms after an injection of an anti-nausea drug. Her case against pharmaceutical giant Wyeth resulted in a jury award of $6.7 million, which the drug manufacturer appealed on the grounds that the drug carried an FDA warning.

An experienced Maryland defective products and drugs attorney like Steven H. Heisler will protect your rights, work hard on your behalf, and help you navigate the legal course to justice. Westminster Teen Dies in Maryland Auto Accident

By injuheis on March 3, 2009

A teenager from Westminster died in an early morning accident on Sunday, January 11, 2009, according to this Carroll County Times report. A spokesman for the Maryland State Police said that Nicholas Tyler Byron, 17, was northbound on Md. 97 near Old Hanover Road when he lost control of his SUV, skidded off the road, and struck a telephone pole shortly after 5 A.M.

The teen was driving a GMC Jimmy Sport Utility Vehicle, and law enforcement officials investigating the accident said that Byron was wearing his seat belt and the airbag deployed when Byron hit the telephone pole. Officials said that weather, road conditions, and speed were contributing factors to the accident and the teen’s SUV was the only vehicle involved in the Maryland auto accident.

Despite efforts by state and local authorities to lower the number of Maryland auto accidents involving teens, a disturbing number of them are killed and injured each year. If you or someone you care for has been injured in an auto accident, Maryland auto accident attorney Steven H. Heisler may be able to help you receive compensation for medical and other expenses.
