BMW Recalls Thousands of Motorcycles Due to Brake Failure Risk

By injuheis on June 30, 2010

According to the NHTSA, 15,532 U.S. motorcycles have been recalled by BMW as a result of possible brake defects. The German manufacturer is concerned that “vibrations could cause the front brake lines to develop leaks that could allow brake fluid to escape. In a worst case scenario, this could lead to a failure of the front brakes,” according to a www.telegraph.co.uk report.

The recalled motorcycles are from the K1200 and R1200 series for model years 2007 to 2009.

Maryland motorcyclists who ride BMW’s need to take this recall seriously. Riding on a motorcycle is hazardous enough, let alone one that has no working front brakes. If you ride a BMW motorcycle, please have your bike examined immediately.

Worn Nylon Jacket May Have Caused Maryland Chemical Plant Fire

By injuheis on June 25, 2010

My office was recently retained by an individual who was severely burned on the face, back and arms as a result of a chemical plant fire in Washington County, Maryland. The State Fire Marshall’s preliminary investigation revealed that a nylon jacket worn by my client “produced a static charge that ignited ‘ordinary combustibles’”.

What was my client doing wearing a nylon jacket around combustibles? Good question. Nylon is highly static and should not be worn around chemicals. You would think that a company in the business of manufacturing chemicals would make it a top priority to educate its workers about this fact. Apparently not. As a result, my client almost died from third degree burns. By the way, only clothes made of cotton should be worn in the presence of chemicals.

Anne Arundel County Hit and Run Accident Kills Highway Worker

By injuheis on June 23, 2010

Tragically, a highway worker was killed earlier this month in Anne Arundel County. He was the first highway worker killed in Maryland since 2006.

Based on a Washington Post report, the employee was working in the left lane of a highway at 1 a.m. His truck, with a flashing light on top, was three lanes away. A vehicle struck him and left the scene. While the worker was lying in the road, a tractor trailer hit him. The driver did not see the injured man in time to stop.

Sadly, the worker was not following safety protocols at the time of his death. Investigators are uncertain why he was on the road at that time. He was required to have a spotter, which he did not have. In addition, safety rules require that any road work should take place within 100 feet in front of his work vehicle. He was, however, wearing reflective clothing. An ambulance coincidentally arrived at the scene within minutes after the accident but the individual was declared dead at the scene.

On average, there is one work zone fatality every 10 hours in the United States, and a work zone injury every 13 minutes. This fatal MD vehicle accident did not have to occur. In addition to the employee following proper safety rules, the driver who struck him should have reacted differently. The driver should have stopped, alerted 911, and taken steps to insure that additional vehicles did not strike the victim.

Maryland Unnecessary Stent Implant Procedures - Are You at Risk?

By injuheis on June 21, 2010

The Maryland Board of physicians, the regulatory board in charge of licensing doctors in Maryland, has accused a Towson cardiologist of performing hundreds of stent implant procedures in patients who may not have even needed them. According to The Washington Post, the cardiologist is suspected of violating several Maryland laws pertaining to the “gross overutilization of health care services” and “willfully making a false report or record in the practice of medicine”.

Not only are stent implants expensive, but they also present potential health risks, such as blood clots. In addition, they create negative long-term effects because the recipient is required to take blood-thinning medications for the rest of his or her life.

Hundreds of patients who received stent implants in Maryland were under the impression that they had significant coronary artery blockage and needed the stent implant in order to open up the blocked the artery. These patients trusted the opinion of the cardiologist, who ran a cardiac catheterization lab at St. Joseph Medical Center until just this last year. However, after detailed review of the cardiologists X-ray images, it appears that he repeatedly overestimated the level of narrowing, or “stenosis,” patients had in their arteries. For instance, several patients displayed less than 50 percent blockage when the cardiologist wrote in the patient’s records that they suffered an 80 percent blockage of a coronary artery.

Once a stent is implanted in a patient, it can never be removed. With this in mind, individuals with stent implants who may not really need them may now face unnecessary emotional, physical and financial challenges. The controversy surrounding the St. Joseph Hospital cardiologist has impacted hundreds of patients’ lives. The Maryland stent implant injury lawyers at The Law Offices of Steven H. Heisler have many years of experience successfully handling medical malpractice and personal injury cases. Contact Steven H. Avoiding Bicycle Accidents in Maryland

By injuheis on June 16, 2010

Once warm weather hits, increasing numbers of Maryland bicyclists take to the streets. Before you join them, be sure to follow standard bicycle safety rules. According to the National Highway Traffic Safety Administration, between 600 and 800 bicyclists were killed in traffic accidents in the U.S. each year between 1998 and 2008.

The best thing you can do to prevent a head injury from occurring during a bicycle crash in Maryland is to wear a properly fitting helmet. In addition to fitting your helmet, adjust your bicycle to fit your body. Is the seat level high or low enough for you? Is the handlebar height the same height as the seat? You should also make sure all other bicycle equipment is working. Do your brakes work? Are your tires properly inflated?

It is crucial to remember that you should not ride a bicycle if you are under the influence of alcohol. It sounds like common sense, but tragically, alcohol was a factor in 37 percent of the traffic crashes that resulted in bicycle fatalities in 2008 either because the bicyclist or a vehicle driver was drinking.

Another important way to avoid Baltimore bike accidents is to make sure you can be seen while you are on your bike. Wear neon or other bright colors when riding, even during the day. Also consider putting something reflective or bright on your bicycle, such as reflective tape or lights. Don’t assume a driver can see you just because you can see him.

Have you or a loved one been injured in a bicycle accident because of someone else’s negligence? You may be granted compensation for your medical bills, lost wages, and pain and suffering with the help of an experience Maryland bicycle accident attorney. Contact Steven H. Heisler, “The Injury Lawyer,” today at 877-228-4878 for a free consultation and to learn more about your legal rights as an injury victim.

Use of Restraints Coming Under Fire in New Jersey

By injuheis on June 9, 2010

New Jersey, which allows both public and private schools to restrain unruly children with disabilities, is coming under fire. Last year, congressional investigators found hundreds of cases of abuse and at least 20 deaths related to seclusion and restraints since 1990 in United States schools. An app.com report mentions that the investigators found cases of disabled children as young as five being bound, held down on the floor or locked in rooms for hours at a time for small offenses.

New Jersey is one of 19 states that does not have laws or regulations dealing with restraints or seclusion in schools. In addition, schools don’t have to report those incidents, maintain written policies on how to handle such problems, or even notify parents if their children are restrained.

Employees of New Jersey schools are allowed to keep children confined in rooms until they settle down, and can use bear hugs and other physical moves to handle unruly children. School employees can also use techniques to control autistic children who injure themselves, including spraying water or chemicals at the children, putting hot sauce in their mouths, or snapping them with rubber bands.

Some say these techniques are necessary as a last resort. However, a bill with support from both Democrats and Republicans establishes national standards for the use of restraints and other coercion in United States schools. The bill limits the use of these methods and bans the use of locked rooms, restraining straps, and drugs not prescribed by a doctor. Schools will also be more accountable than they currently are in terms of the use of restraint.

Similar to New Jersey, incidents of restraint injury in Maryland take place far too often. If your child has been a victim of a MD restraint injury or a death, please contact Maryland restraint injury attorney Steven H. Heisler, “The Injury Lawyer”. He will work hard on behalf of your child to ensure that his or her rights are protected. Call 877-228-4878 today for more information on Maryland restraint injuries and your legal options.

Poor Conditions at Johnson & Johnson Plant Led to Tylenol Recall

By injuheis on June 3, 2010

A manufacturing plant owned by Johnson & Johnson which manufactures Tylenol in Fort Washington, Pennsylvania, was closed because of quality issues and safety violations in early May. Based on a CNN Money report, on May 1, 50 children’s non-prescription drugs were recalled, including Motrin, Benadryl and Tylenol, as a result of an FDA probe into conditions at the factory. The FDA report listed 20 violations, including 46 consumer complaints about the products that were recalled. A House committee is scheduled to hold a hearing this week about the recall.

Among the worst complaints are:

  • that the factory doesn’t have adequate lab facilities to test products;
  • that company officials failed to follow up on consumer complaints of foreign materials in the medicine;
  • a lack of proper controls in the manufacturing of infant Tylenol (leading to overly powerful medicine);
  • untrained employees;
  • filthy conditions at the plant; and
  • contaminated drums that were used to transport raw materials.

The FDA is considering several options against Johnson & Johnson, including completely closing the factory or maintaining a constant third-party inspection at the plant. A Johnson & Johnson spokesman did not comment on how long the facility would remain shut, but a company representative did indicate it would not resume manufacturing until the necessary corrective actions have been taken.
