CPSC Warns of Fireworks Injuries During Fourth of July Weekend
By injuheis on July 1, 2010
A new study by the U.S. Consumer Product Safety Commission (CPSC) reveals that fireworks-related incidents were responsible for two deaths in 2009 and approximately 9,000 emergency room visits for injuries. According to the CPSC, throughout the 30 days near last year’s holiday, about 6,000 injuries involving fireworks were reported in which half of the injuries related to firecrackers, bottle rockets, and sparklers.
Consumers below the age of 20 are the most prone to fireworks injuries; however, the risk of serious injury or even death still exists for anyone within close proximity of fireworks or other apparatuses. Some common fireworks injuries and hazards include lacerations, loss of limbs, burns, residential fires and wrongful death.
Parental supervision is essential when legal fireworks are being used. Never allow young children to set-off or play with fireworks or other gadgets. It is also important to never throw or point fireworks at another individual. To learn more about how you can help prevent serious injuries related to fireworks this Fourth of July holiday, please refer to the CPSC’s website for consumer fireworks safety tips.
Steven H. Heisler, “The Injury Lawyer,” wants consumers to fully understand the importance of safety during the Independence Day holiday in Maryland and nationwide. Do not disregard safety measures. Take every necessary precaution to protect yourself and others.
Connecticut Power Plant Workers Suing Over Injuries Sustained During Explosion
By injuheis on March 24, 2010
According to a recent report, workers injured in a Connecticut power plant explosion have filed a lawsuit against the owners of the facility for failing to provide adequate safety measures that could have prevented the explosion from taking place. The incident occurred when workers were purging a natural gas pipeline, and a buildup of natural gas ignited as it was released. The workers filing the claim sustained head and other injuries. The injured workers’ attorneys claim that their earning potential has been greatly diminished as a result of the accident. A total of six workers lost their lives during the explosion, and dozens more were injured.
The suit alleges that Kleen Energy Systems, the power plant owner, and O&G Industries Inc., the facility’s primary contractor, disregarded implementing certain safety measures in order for completion of the 620-megawatt gas-fired power plant to be sped up. Specifically, it is being argued that Kleen and O&G failed to supervise the purging process and that there was no safety engineer on site on the day of the explosion.
When employees are injured on the job, the circumstances surrounding the work accident need to be carefully examined to determine whether or not negligent action played a contributing role. The workers, of course, have the right to file a workers’ compensation claim. The workers also may have a negligence claim against the party, other than the employer, who might have been responsible for the incident. While the cause of the ignition in the above accident is still unknown, a thorough investigation will undoubtedly take place. For explosion accident victims injured on the job in Maryland, a thorough investigation made by a skilled Maryland explosion accident attorney should also be conducted to ensure that the rights of the injured worker are not infringed upon in a court of law.

Texas Drilling Rig Topples Over, Pins and Injures Worker
By injuheis on March 3, 2010
Certain dangers come along with working on any construction site, particularly when usage of large and heavy machinery is involved. According to a news8austin.com article, a Texas construction worker sustained non-life threatening injuries when the drilling rig he was operating inexplicably toppled over, pinning him between the vehicle and a nearby tractor-trailer. While the cause of the accident is still unknown, authorities are investigating the matter to get a better idea of exactly what happened. After the man was extricated from the vehicle, he was taken to a local medical center for treatment.
Operation of large machinery is not easy, and requires extensive training in order to properly and safely do so. It is the responsibility of construction site foremen to make sure that their employees receive the proper and necessary training to safely maneuver heavy equipment so as to avoid injury. When an employee is injured on the job, the worker has a right to file a workers’ compensation claim against the employer. If negligence of a third party is involved, the worker can file a negligence claim against the third party as well. In such instances, an employee injured may be able to seek monetary compensation for damages resulting from injuries sustained while on the job. Such compensation can be used to help cover the costs associated with an on the job accident, such as medical bills, physical therapy, and even wages lost as a result of injury.

Six Necessary Steps to Take if Involved in a Maryland Work Accident
By injuheis on February 19, 2010
It is every employee’s expectation that their employer creates and maintains a safe working environment in adhering to state and federal laws requiring them to do so. However, employers who fail to properly train employees or disregard dangerous working conditions do a huge disservice to employees, thus putting them at risk of enduring injury, illness, or even death. If you or a loved one has recently endured work related injuries in Maryland, here are six necessary steps to take that you may want to consider.
- Notify Your Supervisor Right Away– If you don’t alert the company in a timely manner, it’s treated by the company like it didn’t happen.
- Demand That An Accident Report Be Written– If the company refuses to write a report, write one yourself and submit it to your supervisor. Make a copy for yourself and have a witness observe you giving it to the supervisor.
- If You’re A Member Of A Union, Notify Your Union Rep As Soon As Possible – You pay union dues so make sure the union goes to bat for you and protects your workplace rights.
- If Anyone Witnessed Your Accident It Is Important That You Get Their Name And Number Right Away – If a witness confirms your story your case is easier to prove.
- Seek Medical Attention At Once – If you are hurt and don’t see a doctor or wait a long time before seeing one, the company might deny your claim and argue that if you were really hurt you would have gotten medical attention as soon as it happened.
- Call A Lawyer So A Claim Can Be Filed – In Maryland, your case has to be filed on a Maryland Worker’s Compensation claim form that can be obtained ONLY from the Worker’s Compensation Commission or a Maryland Work Comp lawyer. DON’T LET THE COMPANY MAKE YOU THINK OTHERWISE!!! Failure to file this claim form with the Worker’s Compensation Commission within two (2) years from your accident could result in you losing all of your Worker’s Compensation rights and benefits.

Frederick County Collision Kills Damascus Motorist
By injuheis on November 10, 2009
Maryland’s local NBC affiliate’s website, your4state.co, recently reported that a two-vehicle crash that took the life of a Damascus motorist is currently being investigated. The accident took place on Bill Moxley Road in Frederick County, and involved a 1989 Chevrolet Cavalier and a 1995 Chevrolet Corsica. Authorities believe the two vehicles struck each other as they were coming over a hill. Five people were injured in the crash, with only the driver of the Cavalier succumbing to his injuries. The other accident victims riding in the Cavalier, a 17-year-old boy and a 19-year-old girl, sustained injury and were taken to Baltimore Shock Trauma for treatment. The driver of the Corsica, a 51-year-old man, and his female passenger also sustained injury and were also taken to Baltimore Shock Trauma. The conditions of all individuals involved were not made public.
Although this accident is still being investigated, some sort of negligent action will undoubtedly emerge as having contributed towards its occurrence. That is, negligent action that can contribute towards an auto accident can take a variety of forms. Reckless driving is one of the primary causes of all auto accidents. Driving at speeds greater than posted limits, failing to abide to traffic signage and signals, and failure to yield the right of way to other vehicles are all ways in which negligent action can lead to an auto accident. However, negligent action on the part of local municipalities can also contribute towards an accident. Specifically, if roads are not properly maintained, potential hazards are not properly made known to motorists, or traffic signage is obscured or faded to the point that such signage is illegible and, thus cannot, be followed, then the likelihood of an accident occurring is greatly increased. Regardless of the situation though, it is always a good idea to retain the services of a skilled Maryland auto accident attorney in the event that you become involved in an auto accident.
While the cause of accidents varies from one case to the next, the root of that cause is typically steeped in negligence. Drugs More Deadly Than Car Accidents, For Now
By injuheis on October 26, 2009
A recent Associated Press article revealed that the number of deaths caused by drugs is now greater than the number of deaths caused by traffic accidents in the state of Maryland. It has been speculated that more commonly prescribed painkilling opiates are to blame, and that doctors and physicians are prescribing the substances at a much greater rate than in previous years. According to an epidemiologist with the CDCP, “People see a car accident as something that might happen to them,” but may view drug overdose “as something that’s not going to happen to them.” With estimates labeling one in five U.S. adults as being prescribed an opiate of some kind each year, the question arises as to whether or not the number of motor vehicle accidents will eventually once again surpass the number of drug deaths, particularly since the likelihood of individuals driving while under the influence of prescription medication is bound to rise as the number of patients dependent on painkillers continues to increase.
The epidemiologist also added that the drop in traffic fatalities is “considered one of the great public health triumphs” in recent history, but such a drop certainly won’t benefit if more and more individuals find themselves able to easily acquire prescription painkillers. The issues of medical malpractice and reckless driving are both brought into question here. In one regard, while the vast majority of medical professionals prescribe painkillers because their patients do in fact need them, all medical personnel needs to more vigilant in deciphering between a need for medication, and an unnecessary dependency on it. Furthermore, lax judgment in regard to prescribing such medications needs to be addressed to ensure that the safety of not only the medicated individual, but of all other individuals in Maryland, is given careful consideration.
Consequently, while the number of traffic fatalities has thankfully decreased, the number of traffic accidents remains vulnerable to being negatively impacted by the increase of medicated individuals out and about on Maryland roads and highways. Operating a motor vehicle while under the influence of either drugs or alcohol constitutes utter reckless, and all incidents that are deemed as such become the responsibility of those individuals that chose to exhibit and partake in such dangerous behavior. Any time one person is injured because of the negligent action of another, an experienced personal injury attorney in Maryland should be consulted to ensure that the rights of the injured party are upheld in a court of law.
If you have been injured in a traffic accident, whether it was caused by an utter disregard for traffic laws or because the other party involved chose to drive while under the influence of drugs or alcohol, don’t hesitate to contact Steven H. Heisler, “The Injury Lawyer,” for a free evaluation of your case, and his experienced attorneys will ensure that your rights are upheld at all times. Please call us today for your free consultation.

Police Officer Injured by Truck on Baltimore-Washington Parkway
By injuheis on October 7, 2009
According to The Baltimore Sun, a male police officer was injured while conducting a routine traffic stop on the Baltimore-Washington Parkway near Route 197. After having pulled a vehicle over to the side of the road, the officer parked, exited his own vehicle, and began writing up the traffic citation. A pickup truck, having left the roadway, proceeded to plow into the back of the parked police cruiser, which in turn careened into the vehicle the police officer was issuing the traffic citation to. The officer, who had been standing at the driver’s side window of the pulled over car, was forced underneath the police cruiser and was dragged for about 40 feet.
The police officer was taken to Washington Hospital Center for treatment. His injuries were deemed nonlife-threatening, an excellent outcome in any traffic related accident. However, many victims of traffic accidents are not so lucky, and severe injury is often sustained, particularly when a person is dragged any length of distance by an operating vehicle.
At the time of this article, it was not determined whether or not the driver of the pickup was under the influence of any sort of illicit substance, or simply chose to drive recklessly, injuring another person in the process. The driver of the truck was taken to Prince George’s Hospital Center for observation, and it was not made public whether or not the driver sustained any sort of injury. The circumstances surrounding this accident will undoubtedly be revealed after an investigation, one which will attribute fault towards one or more determining factors that caused the crash.
Not all accident victims are as lucky as the police officer was. Often times, injury sustained is so great that recovery time can prevent a person from going about their daily routine, even forcing that person out of work. However, it should be noted that monetary loss associated with traffic accidents does not need to burden the victim. Those responsible for the traffic accident can and should be held liable for their actions, and monetary compensation should be awarded to injured victims.
If you or a loved one has suffered personal injury as the result of a traffic accident, you’ll need an experienced Maryland personal injury lawyer on your side to help sort through the details of the incident. Please call Steven H. Heisler, “The Injury Lawyer”, for a free evaluation of your case. Steven H. Heisler and his attorneys will ensure that your rights as an accident victim are never infringed upon.

Maryland Police Warn Drag Racers after Recent Fatal Auto Accident
By injuheis on July 30, 2009
Police in Maryland are trying to take several steps including installing rumble strips, cameras and other devices to slow down street racers after two people were killed in what officials say was a fatal car accident in Maryland caused by illegal drag racing, according to this Associated Press news report. Two people were killed earlier in June and two injured when a car crashed into another vehicle on the Interstate 70 after an illegal drag race took place. Two other individuals, who were bystanders, were seriously injured.
Street racing has caused significant personal injuries and deaths not only in Maryland, but all over the nation. According to the National Highway Traffic Safety Administration (NHTSA), there were reports of 135 fatal car accidents that involved street racing in 2001, a number that had almost doubled since 2000. Nationwide, statistics also show that 49 people are injured for every 1,000 people who participate in illegal street racing.

Zicam Defective Drug Recall Begins
By injuheis on July 23, 2009
Matrixx Initiatives is issuing a product recall of several Zicam intranasal cold remedies a week after federal regulators told the company to stop selling its products that were apparently causing consumers to lose their sense of smell. According to a Reuters news report, the U.S. Food and Drug Administration (FDA) recently issued a warning to consumers that several Matrixx Zicam cold remedies, such as sprays and gels, were not safe to use because they contained zinc, which has the potential to damage a nerve that affects the sense of smell.
On June 16, 2009, the FDA warned Matrixx to stop selling these defective drugs after more than 130 reports of people losing their sense of smell after using the products. The FDA also urged consumers to stop taking the over-the-counter products.
There are a variety of state and federal laws, which govern the manufacture, production, labeling and distribution of pharmaceutical products. Drug makers are expected to exercise a certain standard of care that includes safe labeling, appropriate manufacturing conditions, and informing doctors about the risks of their drugs. However, brief testing periods and unsafe manufacturing conditions can lead to massive drug recalls, which can affect a drug company’s reputation and endanger the lives of innocent victims who can experience lasting and even deadly side effects. State statutes of limitations for filing pharmaceutical claims can be limited, so it’s a good idea to consider your legal options as soon as possible after sustaining injury due to an unsafe drug product.
If you have sustained injury due to a drug, it is best to contact an experienced Maryland pharmaceutical litigation attorney who can help you pursue your legal rights. The law offices of Steven H. Heisler specifically serve personal injury victims and can help you if you or a loved one has been injured by unsafe drugs including Zicam. Ocean City Hit-and-Run Auto Accident Kills One, Injures One
By injuheis on July 16, 2009
Maryland State Police arrested a hit-and-run driver who they say struck and killed a bicyclist and injured another in an Ocean City auto accident in Maryland. According an Associated Press news report, the two bicyclists were riding their bikes on the Route 50 bridge west of Ocean City where they were struck down by a pickup truck. The driver of the truck did not stop at the scene. A witness followed the truck and called police. Authorities were able to pull over the truck and arrest its driver, charging him with negligent homicide by motor vehicle while under the influence, driving under the influence of alcohol and failing to remain at the scene of an accident involving the death of another.
Vehicular homicide, driving under the influence of alcohol, and leaving the scene of an accident are extremely serious offenses in the state of Maryland, punishable by significant jail time and hefty fines. There is no question that a person who is convicted of these offenses must be held both criminally and civilly liable for causing an accident and the resulting injuries or death. In cases where such negligence is involved, families of deceased victims are also able to file wrongful death claims, which may help compensate them for medical or funeral expenses, loss of wages, past and future pain and suffering, loss of companionship and other damages.
If you have been injured in a Maryland auto accident or have lost a loved one as a result of wrongdoing or negligence, please call experienced Maryland auto accident attorney and wrongful death claim lawyer Steven H. Heisler for a free and comprehensive evaluation of your case.
