Maryland Pharmaceutical Litigation Lawyers

prescription-lawsuitsConsumers believe they’re safe. After all, why would doctors prescribe dangerous drugs? However, pharmaceutical litigation is on the rise due to unsafe or defective drugs that are widely prescribed, then recalled and taken off the market. Recent news has been full of reports of defective drugs, including COX-2 inhibitors, erectile dysfunction drugs, osteoporosis treatments, psychiatric drugs, and cholesterol medications.

The manufacturers who create and distribute defective drugs can be held liable for improper labeling, unsafe side effects, or defects that make innocuous-seeming drugs dangerous and even deadly. In addition, medical professionals who use drugs “off-label” (for alternative uses not listed on their packaging) could be held responsible for medical malpractice if these off-label uses lead to injury or death in patients.

Various federal and state laws govern the manufacture, production, labeling, distribution and prescription of pharmaceuticals. Drug manufacturers generally are expected to exercise a certain standard of care that includes safe labeling, appropriate manufacturing conditions, and informing doctors about the risks of their drugs. However, too-short testing periods and unsafe manufacturing conditions can lead to massive drug recalls, which can affect a drug company’s reputation, stock price, and endanger the lives of innocent victims who can experience lasting and even deadly side effects. State statutes of limitations for filing pharmaceutical claims can be limited, so it’s a good idea to consider your legal options as soon as possible after sustaining injury due to an unsafe drug product.

Vioxx

The Food and Drug Administration recently announced the voluntary recall of the pain medication Vioxx. Vioxx, a cox-2 inhibitor, is a Merck and Co. product intended to alleviate pain related to arthritis and menstrual symptoms. Studies have revealed that the use of Vioxx greatly increases the risk of heart attack and stroke. What’s worse, Merck & Co. had knowledge of the dangerous side effects of Vioxx and concealed it from the public. If you or a loved one had a heart attack or stroke while taking Vioxx, contact Steve immediately.

Accutane

Since its approval by the Food and Drug Administration in 1982, over 12 million people have taken the medication Accutane. Accutane is a Hoffman-La Roache product prescribed for the treatment of acne. The side effects from Accutane are horrific. Accutane has been associated with severe birth defects, severe psychiatric side effects, as well as damage to the liver, kidneys, central nervous system, pancreas, gastrointestinal tract, cardiovascular system, musculoskeletal system, and other conditions affecting the auto-immune system of the human body. Accutane is marketed primarily to teens and young adults. It is one of the top three drugs for the most reported adverse side effects to the Food and Drug Administration. If you or a loved one has suffered any of the previously mentioned side effects while taking Accutane, contact Steve immediately.

Paxil

The Food and Drug Administration is warning that the anti-depressant drug Paxil can cause violence and suicide in children and teenagers. Paxil is normally prescribed for depression but is also used to treat anxiety, obsessive compulsive disorder, panic attacks, and Post Traumatic Stress Disorder (PTSD). A British study of 1,000 young people showed an increase in suicidal behavior among those under 18 who were taking Paxil. If you or a loved one has been harmed by the drug Paxil, please contact Steve immediately.
